====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 12-04-2019 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks bail in connection with Sahebganj P.S. Case No.479 of 2018 registered under Sections 467, 379 and 411 of the Indian Penal Code.

The allegation of the informant is that in the night of 23/24.12.2018, the petitioner and Md. Sajjad stolen his mobile, they also committed the theft of the battery of truck of Harendra Sahni and they also took cash Rs.20,000/- from the cash box of the fruit shop of Md. Ejaj.

Learned counsel appearing on behalf of the petitioner submits that the petitioner has falsely been implicated in this case on mere suspicion and having no criminal antecedent is in

Patna High Court CR. MISC. No.23647 of 2019(2) dt.12-04-2019 2/2 custody since 25.12.2018. Further submission is that on investigation, the police has already submitted the chargesheet against the petitioner.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-I (West)- cum-Sub-Judge, Muzaffarpur, in connection with Sahebganj P.S. Case No.479 of 2018. Out of the two sureties, one must be close relative of the petitioner, who will file an affidavit giving genealogy as to how he/she is related with the petitioner. The bailors will undertake to furnish information to the court about any change in the address of the petitioner.
