The petitioner apprehends his arrest in Complaint Case No.1306(c) of 2015 registered under Section 406 of the Indian Penal Code.

The complainant alleged that petitioner took Rs.10 lacs for running brick kiln business with assurance to return the same within six months. Petitioner also executed an agreement of receiving Rs.6,42,500/-.

The learned counsel for the petitioner submits that complainant is partner in the brick kilning business with the petitioner. The petitioner supplied bricks through Munshi of the complainant but payment of the supplied bricks through Munshi

Patna High Court CR. MISC. No.27915 of 2019(2) dt.29-04-2019 2/2 of the complainant was not given. The dispute arose due to nonrendition of amount. The petitioner gave detailed reply to the notice given by the complainant.

Taking into consideration the facts aforesaid and nature of allegation made against the petitioner and the fact that dispute arose during the course of business, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.- cum-Sub Judge VI, Danapur, Patna in connection with Complaint Case No.1306(c) of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
