Petitioner seeks regular bail in connection with Sakra PS Case No. 39 of 2021 registered for the offence punishable under Sections 379 / 413 / 411 / 414 of the IPC. As per the First Information Report the motorcycle of the informant was parked in front of his house which was being taken away by some persons and upon chase the accused persons were caught by the villagers who disclosed their names as Kundan Kumar, Aman Kumar along with Lalu Kumar Sah (i.e. the petitioner).

Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case and no stolen motorcycle has been recovered from the possession of the petitioner. He further submits that petitioner has got no criminal

Patna High Court CR. MISC. No.35827 of 2021(3) dt.22-03-2022 2/2 antecedent and he is in custody since 16.01.2021. Charge-sheet has been submitted in the matter. He further submits that coaccused / Kundan Kumar, Md. Rustam and Aman Kumar have been granted bail by this court in Cr. Misc. Nos. 41893 / 2021 , 38120 / 2021 and 31820 of 2021.

Having regard to the submissions made by the parties and taking into consideration the material on record and the fact that the petitioner has got no criminal antecedent, he is in custody since 16-01-2021, charge-sheet has been submitted in the matter and similarly situated co-accused persons have been granted bail by this court, as such, I am inclined to grant regular bail to the petitioner.

Accordingly, let the petitioner, above named, be released on regular bail on furnishing bail bond of Rs. 25000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. -12, Muzaffarpur in connection with Sakra PS Case No. 39 of 2021.
