JUSTICE ASHWANI KUMAR SINGH ORAL JUDGMENT Date: 10-03-2017 In the present writ application, the petitioner has prayed for payment of entire retiral benefits such as pension, gratuity, GPF, group insurance and leave encashment. 2.

Despite repeated calls, nobody appears on behalf of the petitioner to press the writ application. 3.

Learned counsel for the Bihar State Power Holding Company Limited (for short 'Company') is present. 4.

A counter affidavit has been filed on behalf of respondent no. 7 wherein it is stated that the petitioner has been sanctioned full pension and payment of the same has also been started and so long as arrears of pension is concerned, the petitioner has already been paid Rs.1,73,380/- through cheque no. 479292 dated 08.12.2014 and Rs.3726 through cheque no. 637563 dated 23.09.2015. It is further stated in the counter affidavit that the petitioner has already been paid his gratuity of Rs.8,41,698/- through cheque no. 637538 dated 13.10.2015 and he has also been paid leave encashment of Rs.4,92,338/- through cheque no. 388414 dated 10.12.2015. It is further stated that the amount of group insurance of Rs.1,29,432/- through cheque no. 706700 dated

Patna High Court CWJC No.10009 of 2014 dt.10-03-2017 3/3 20.10.2014 and amount of GPF worth Rs.18,31,974/- through cheque no. 479219 dated 21.11.2014 have also been paid to the petitioner.

Learned counsel for the respondent-Company submitted that since the petitioner has been paid all his retiral benefits, including regular pension, the writ application has become infructuous.

Considering the averments made in the counteraffidavit filed on behalf of respondent no. 7 and the submission made by the learned counsel for the respondent-Company, the writ application is disposed of as infructuous.
