Counsel for the petitioners submits that from the document Annexure A dated 27.08.2014 issued by the Director, Science and Technology Department, Bihar, Patna, it is apparent that issue regarding requisite qualification for promotion of Instructor to the post of Foremen is yet to be decided. Order of the Director is dated 27.08.2014. Till date neither petitioners nor the State counsel has placed on record what has been the outcome of pending consideration before the Director.

Patna High Court CWJC No.13153 of 2006(11) dt.08-11-2019 2/2 Petitioners' claim in the instant proceedings for being promoted as Foremen would depend on final decision taken by the Director pursuant to order dated 27.08.2014. In view of the aforesaid position, this court would dispose of the writ petition with direction, that if final decision has not been taken as yet, the same shall be done by respondent no.3 positively within three months from the date of receipt/production of a copy of this order.

Writ petition stands disposed of.
