The two petitioners herein pray for grant of anticipatory bail in Khaira P.S. Case No. 22 of 2015 registered under sections 147, 149, 341, 323, 504 and 307 of the Indian Penal Code. The case was registered in 2015 whereas the present application for anticipatory bail is filed at the fag end of this year. That apart, the allegation against petitioner no. 1 is of having caused injury by axe on the head of the informant whereas the allegation on petitioner no. 2 is of causing injury on the father of the informant by means of lathi and danda.
Counsel for the petitioners submits that there is a counter version also. After 10 days of the occurrence, initially a complaint was lodged which was later treated as an F.I.R. On a trivial issue,
Patna High Court Cr.Misc. No.47862 of 2016 (2) dt.30-11-2016 2/2 it would appear that parties fought against each other. Learned APP opposed the prayer and submits that the petitioners become absconders in the eyes of law for pretty long time.
Considering the allegation as well as the materials reflected from the record, I am not inclined to privilege the petitioners with anticipatory bail. Prayer is rejected.
Let the petitioners surrender and pray for bail which shall be considered on its own merit unprejudiced by the present order. (Kishore Kumar Mandal, J) Pankaj/- U T
