JUSTICE SANJAY PRIYA ORAL ORDER 03-10-2017 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in Wazirganj P.S. Case No. 189 of 2016 instituted for the offence under Sections 341, 323, 307, 354, 379, 504, 506 and 34 of the Indian Penal Code.

As per written report, there is specific allegation against this petitioner of assaulting the husband of the informant on his head, on account of which, he became unconscious and fell down.

Case diary has been received wherein the Doctor has found three injuries on the person of the husband of the informant. The injuries No. 1 and 2 are lacerated wound on right side and left side of middle of head measuring 2" x 1⁄2" x 1⁄2" and the opinion

Patna High Court Cr.Misc. No.40725 of 2017 (4) dt.03-10-2017 2/2 was kept reserved. The patient was referred to A.N.M. College, Gaya.

From the injury report it appears that there is repetition of blow.

Therefore, this Court is not inclined to grant anticipatory bail to the petitioner.

Prayer for anticipatory bail of the petitioner stands rejected.

Petitioner may surrender before the court below and make prayer for regular bail which shall be disposed off by the court below in accordance with law without being prejudiced by this order.
