The petitioner has prayed for bail in a case registered for the offence punishable under sections 147, 148, 149, 341, 323, 307, 461, 427, 504, 506 of the Indian Penal Code. Later on Section 302 IPC was added.

As per allegation in the FIR, some anti-social elements broke the lock of shop of informant. They took out the all articles from the shop and they kept their own articles in the shop. When the brother of the informant, namely, Sadab Ilyas inquired about it, then the accused persons including the petitioner assaulted Sadab Ilyas with rod and hammer and injured him.

It is submitted by learned counsel for the petitioner

Patna High Court CR. MISC. No.26526 of 2023(2) dt.23-05-2023 2/2 that petitioner has been falsely implicated in this case. Similarly situated other accused persons have already been granted bail by the court below before the death of deceased, (Annexure-5). Petitioner has got no criminal antecedent and languishing in custody since 5.11.2022.

The application for bail is opposed by learned APP for the State and learned counsel for the informant. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned ACJMX, Bhagalpur in connection with Sanhaula P.S. Case No. 156 of 2022.
