It is alleged that the petitioners have take away the minor child of the informant to get job for him at Ludhiana but the child is not being returned now. He is traceless. Learned counsel for the petitioners submits that in fact this is a false and concocted case inasmuch as before this, a complaint had been filed by petitioner No 3 who is the father of petitioner No 2 and cousin of petitioner No 1 as against the informant Krishnandan Sah being Complaint Case No 404 of 2016

Patna High Court Cr.Misc. No.30931 of 2016 (3) dt.04-10-2016 2/2 on which learned Magistrate, having taken cognizance on 21.03.2016, referred the matter for enquiry to the police under Section 192 of Criminal Procedure Code (Cr P C). It is only in retaliation thereto that the present case has subsequently been lodged also as a complaint which was later referred to police under Section 156 (3) of Cr P C.

Be that as it may, in the event of their arrest or surrender within five weeks from today, the petitioners abovenamed shall be released on bail on each of them furnishing bonds of Rs 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Sitamarhi in Runni-Saidpur PS Case No 142 of 2016 subject to all conditions as laid down in Section 438 (2) of Cr P C.
