JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 17-04-2019 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 20, 22, and 24 of the N.D.P.S Act.
40 pudia of Ganja are said to have been recovered from conscious possession of the petitioner but the weight of seized Ganja has not been disclosed either in written report or in seizure list. Therefore, it would be presumed that the seized recovery does not come under the definition of commercial quantity.
No doubt, petitioner does have criminal antecedent of some cases but he was never made accused for the offence of

Considering the aforesaid facts and circumstances as well as submissions of the parties and also taking note of this fact that the petitioner is languishing in jail custody since 12.12.2018, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II, Patna in connection with Special Case No. 141 of 2018 arising out of Patrakar Nagar P.S. Case No. 742 of 2018.
