The petitioner seeks anticipatory bail in connection with Amba PS case no. 157 of 2017 registered for the offences punishable under Section 379 of the Indian Penal Code.
The allegation is regarding the attendance register being missing from the office of the Anchal Adhikari, Kutumba Block. The petitioner is stated to be a clerk in the said office. The learned counsel for the petitioner submits that at best the department could have proceeded departmentally, but no criminal offence is made out. It is further submitted that the petitioner has a clean antecedent.
Having regard to the facts and circumstances of the case, in
Patna High Court Cr.Misc. No.10359 of 2018 (2) dt.21-02-2018 2/2 the event of arrest or surrender before the concerned court within a period of six weeks from the date of receipt/production of a copy of the present order, the petitioner above named is directed to be released on anticipatory bail on furnishing bonds of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Aurangabad (Bihar) in connection with Amba PS case no. 157 of 2017, subject to the conditions laid down under Section 438(2) of Code of Criminal Procedure.
