JUSTICE VINOD KUMAR SINHA ORAL ORDER 01-02-2018 Petitioner apprehends his arrest in connection with Jiyapokhar P.S.Case No. 9 of 2017 registered for the offences under Sections 420, 406, 465, 467, 323 and 354 of the Indian Penal Code.

Allegation against the petitioner is of cheating of Rs.25,000/- of the informant which was deposited in the company of the petitioner and on maturity he has not returned the money to the informant.

Submission of learned counsel for the petitioner is that the matter has been compromised between the parties and petitioner is ready to pay back the amount.

Heard learned APP and learned counsel for the informant.

No.3969 of 2018 (2) dt.01-02-2018 2/2 In the facts and circumstances, this application is disposed of with a direction that if the petitioner surrenders within a period of four weeks and petitioner is ready to return the amount within the fixed period, learned court below shall release the petitioner on provisional bail for a period of three months to its own satisfaction and once the total amount is deposited the bail bond of the petitioner shall be confirmed.
