JUSTICE ARVIND SRIVASTAVA ORAL ORDER 20-02-2018 Heard learned counsels for the petitioner and the State. Petitioner apprehends arrest in connection with Excise Case No. 4149 of 2017 arising out of Kashichak (Shahpur O.P.) P.S. Case No. 69 of 2017 registered for the offence punishable under sections 272, 273 of the Indian Penal Code and section 30(a) of the Bihar Prohibition and Excise Act, 2016. Learned counsel appearing for the petitioner submits that petitioner has no concern with the alleged recovery. He has been falsely implicated in this case merely on the disclosure of the driver of the pick-up van. As a matter of fact, nothing has been recovered from the conscious possession of this petitioner. Petitioners is a man of clean antecedent.

Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the petitioner,

Patna High Court Cr.Misc. No.9473 of 2018(2) dt.20-02-2018 2/2 above named, in the event of arrest or surrender within a period of four weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge II-cum-Special Judge, Nawada in connection with Kashichak (Shahpur O.P.)
