08-11-2016 Heard Sri Ranjit Kumar Singh, learned counsel for the petitioner and Sri Laxmi Kant Sharma, learned Addl. Public Prosecutor.

The sole petitioner, who apprehends his arrest in Asarganj P.S. Case No. 28 of 2016, G.R. No. 750 of 2016, registered for offence under Sections 20 and 22 of the Narcotic Drugs & Psychotropic Substances Act, 1985, has prayed for grant of anticipatory bail.

It was submitted by learned counsel for the petitioner that in the occurrence, though recovery of about 5 kg. of Ganja was effected from the house of the petitioner, he was not present and only his mother was arrested. Subsequently, the mother of the petitioner was released on bail. A plea was taken that at the time

Patna High Court Cr.Misc. No.35303 of 2016 (2) dt.08-11-2016 2/2 of occurrence, he was not present in the area. Keeping in view nature of accusation and the fact that petitioner is one of the named accused in the F.I.R., there is no reason to extend the privilege of anticipatory bail. Dismissed.
