The petitioner seeks bail in connection with Rajpur P.S. Case No. 220 of 2018 registered under Sections 30(A) of Bihar Excise (Amendment) Act, 2018.

The accusation is that on receiving a secret information, police stopped a motorcycle and after seeing the police party, they started to flee away but after chase one person was apprehended who disclosed his name as Paramhans Pandey and he also disclosed the name of the petitioner, who succeeded in fleeing away. On search, 40 bottles each containing 180 ml. of country made foreign liquor was recovered from the motorcycle.

No.23627 of 2019(6) dt.12-04-2019 2/2 The learned counsel appearing on behalf of the petitioner submits that petitioner was not apprehended on spot rather his name has surfaced in the confessional statement of co-accused Paramhans Pandey. Petitioner is in custody since 27.02.2019.

Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on bail on execution of bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.D.J.-II-cum-Special Judge(Excise) Act, Buxar in connection with Rajpur P.S.
