When the case was called out, learned counsel for the petitioner, at the very outset, submits that he may be allowed to withdraw this writ application with liberty to approach the appropriate forum i.e., Bihar Land Tribunal, which is functional now as he has an alternative efficacious remedy by filing an

Patna High Court CWJC No.9062 of 2026(2) dt.07-07-2026 2/2 appeal before the Bihar Land Tribunal under the provisions of the Bihar Land Tribunal Act, 2009.

3. Learned counsel appearing on behalf of the State also supports the contention of the petitioner and submits that he has an efficacious alternative remedy before the Bihar Land Tribunal.

4. In view of the prayer so made on behalf of the learned counsel for the petitioner, this writ application is disposed off with liberty to the petitioner to file an appropriate application before the appropriate forum in terms of the appropriate provisions of law.

5. It goes without saying that if any question of limitation arises before the competent authority, the same shall be considered taking into consideration the fact that the petitioner was pursuing the issue before this Court under Article 226 of the Constitution of India.
