JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 28-03-2018 Heard learned counsel for the petitioners and the learned counsel for the State.
This application has been filed by the petitioners for modification in the order dated 20.06.2017 passed in Criminal Misc. No. 8435 of 2017 by this court to extend the period of surrender of the petitioners in the court below. Learned counsel for the petitioners submits that vide order dated 20.06.2017 passed in Criminal Misc. No. 8435 of 2017, the petitioners were ordered to release on bail, in the event of arrest or surrender, on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the S.D.J.M. Birpur (Supaul), in connection with
Patna High Court Cr.Misc. No.16254 of 2018 (2) dt.28-03-2018 Birpur (Balua Bazar) P.S. Case No. 06 of 2014, subject to the conditions laid down under Section 438(2) Cr.P.C. But the petitioners could not surrender within the stipulated period due to personal difficulties. In that view of the matter, learned counsel for the petitioners prays for extension of period of surrender of the petitioners in the court below.
Considering the submission of the learned counsel for the petitioner, the period of surrender of the petitioner in connection with the aforesaid case in the court below is further extended for three weeks from today and this applications is, accordingly, allowed with the aforesaid modification in the order dated 20.06.2017 passed in Criminal Misc.
