The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 272, 273/34 of the Indian Penal Code and 47(a) of the Excise Act. 220 sachets of country made liquor of 200 ml. each were recovered from the house of the petitioner. It is submitted by learned counsel for the petitioner that the seizure witnesses belong to different village and a statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.

The aforesaid facts constitute ground for consideration of prayer for regular bail, if the petitioner

Patna High Court Cr.Misc. No.53669 of 2015 (2) dt.26-11-2015 2/2 surrenders before the learned court below within a period of six weeks from today in connection with Kudhani P.S. Case No. 347 of 2015 pending in the court of learned Judicial Magistrate, Ist Class, Muzaffarpur.

With the aforesaid observation, this application is disposed of.
