The petitioners are apprehending their arrest in a case registered for the offences punishable under sections 341, 323, 384, 379 and 504/34 of Indian Penal Code. Accusation is of making assault to the informant and snatching mobile and chain. It is also alleged that earlier point of time, petitioner no. 2 had made extortion demand of Rs. 2, 00,000.

It is submitted by the learned counsel for the petitioners that the occurrence took place on 8.7.2015, whereas the

Patna High Court Cr.Misc. No.53773 of 2015 (2) dt.26-11-2015 2/2 first information report was lodged on 11.7.2015. The delayed lodging of case constitutes ground for consideration of prayer for regular bail of the petitioner, if they surrender before the learned court below within a period of six weeks from today in connection with Manihari P.S. Case No. 80 of 2015 pending in the court of Chief Judicial Magistrate, Katihar With the aforesaid observation, this application is disposed of.
