The petitioner seeks bail in Chhatauni P.S. Case No. 101/2018, instituted for offence under Section(s) 379 and 420 of the Indian Penal Code.
Learned counsel for the petitioner has submitted that petitioner is not named in the written report. It is alleged in the written report that on the date of occurrence informant was withdrawing money from S.B.I. ATM booth situated at Bariyarpur Railway Gumti then one boy on the pretext of helping her changed her ATM Card. Thereafter at night the informant received message on her mobile about withdrawal of Rs. 20,000/- from her ATM Card. Learned counsel for the petitioner has submitted that
Patna High Court CR. MISC. No.26612 of 2019(2) dt.24-04-2019 2/2 petitioner was arrested in Turkauliya P.S. Case No. 737/2018 on 10.11.2018. Police has recorded the confessional statement of petitioner in that case.
Petitioner is in custody since 24.12.2018.
Considering the aforesaid facts and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, East Champaran, Motihari, in connection with Chhatauni P.S. Case No. 101/2018, subject to the conditions that both the bailors shall be the close relative of the petitioner. (Sanjay Priya, J) rakhi/- U T
