The petitioner is apprehending his arrest in a case registered under Sections 363, 365 and 504/34 of the Indian Penal Code.

The prosecution case, in brief, is that on the alleged date and time of occurrence when the daughter of the informant was alone in his house, then the accused persons enticed away his daughter to Belaganj market, from where the petitioner took her on motorcycle and fled away. When the informant went to the house of the petitioner, his mother and father abused him and Korma Paswan threatened him to kill by showing revolver. Patna High Court Cr.Misc. No.50175 of 2016 (2) dt.23-11-2016 2/2 petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case. The victim has been examined under Section 164 Cr.P.C. She has denied the allegations made in the F.I.R.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, in the event of arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Gaya in connection with Belaganj P.S. case No.141 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
