The petitioners apprehend their arrest in connection with Chhatapur P.S. Case No. 143 of 2017 registered for the offence(s) punishable under section(s) 341, 323, 379, 307, 504, 506, 34 of the Indian Penal Code.
It has been alleged that all the three petitioners restrained the informant from constructing/preparing the house and on protest, on the order of Vidhyanand Mehta @ Bidyanand Mehta, petitioner no. 1 Kritanand Mehta @ Krityanand Mehta assaulted the son of informant on his head by the iron rod and when the wife of the informant went to save his son, she was also
Patna High Court Cr.Misc. No.37927 of 2017 (2) dt.16-08-2017 2/3 assaulted by the petitioners.
It has been submitted that on account of land dispute scuffle took place between the parties for which petitioner no. 2 lodged a case, vide Chhatapur P.S. Case No. 144 of 2017.. Learned Additional Public Prosecutor on the other hand opposed the submission.
The son of the informant, in the said assault, sustained grievous injury attributed to petitioner no. 1. So Considering the grievance injury in nature, the prayer of anticipatory bail of petitioner no. 1 is rejected. So far other petitioners is concerned, they allegedly assaulted by fists, gave order to assault and further the occurrence took place on account of land dispute and both parties are resident of same place.
Having regard to aforesaid facts and circumstances, the prayer of anticipatory bail of petitioner nos. 2 and 3 is allowed. Let petitioner nos. 2 and 3, namely, Vidhyanand Mehta @ Bidyanand Mehta and Manoj Mehta, in the event of arrest or surrender before the court below within a period of six weeks from today, be released on bail on their furnishing bail bond of Rs. 10,000/-(Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief
