ANJANA MISHRA ORAL ORDER 10-11-2015 Heard learned counsel for the petitioners and the learned counsel appearing on behalf of the State. The petitioner Bhupendra Kumar @ Bhupendra in Cr. Misc. No.32855 of 2015 and petitioner Sudhir Kumar in Cr. Misc. No.35901 of 2015 being the Cashier and Computer Operator

Patna High Court Cr.Misc. No.32855 of 2015 (3) dt.10-11-2015 2/3 respectively of Punjab National Bank, Bhagwanpur in the district of Saran are apprehending their arrest in connection with Marhowrah P.S. Case No.414 of 2014 registered for the offences punishable under Sections 409, 420, 467, 468, 471/120 B of the Indian Penal Code.

It is submitted on behalf of the petitioners that these two persons have no role to play in handling the A.T.M. Card of any account holder.

Learned counsel for the petitioners submits that these petitioners having no role to play in the present case of misappropriation and may be extended the privilege of anticipatory bail as has been done in the case of the Branch Manager and another Assistant of the concerned Bank. The said order has been brought on record by way of Annexure-3 which is in order passed in Cr. Misc. No.18194 of 2015 along with Cr. Misc. No.23284 of 2015.

Considering the fact that these two petitioners are similarly situated, let the petitioners, above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand)each with two sureties of the like amount each to
