JUSTICE ANIL KUMAR SINHA ORAL ORDER 31-08-2021 Heard Mr. Pramod Kumar, learned counsel for the petitioner and Mr. Majid Mahboob Khan, learned A.C. to A.A.G.- 12 for the State through video conferencing. The petitioner has filed the present writ application for a direction to the concerned authority to ensure the construction of Panchayat Sarkar Bhawan of Gram PanchayatUttari Shripur, Block - Sagauli, District- East Champaran, Motihari as per the norms of the Government inasmuch as

Patna High Court CWJC No.9665 of 2020(4) dt.31-08-2021 2/3 according to the petitioner the old Panchayat building is situated in the centre of the Panchayat Headquarter but with vested interest the present Mukhiya and some of her associates are constructing the Panchayat Sarkar Bhavan in a village which is far away from the Headquarter of the Panchayat. Learned counsel for the petitioner submits that a detailed representation in this regard has been submitted before the District Magistrate, East Champaran, Motihari but no action has yet been taken by the District Magistrate on the representation of the petitioner.

Learned counsel appearing for the State submits that though six weeks' time was granted earlier to file counter affidavit, but the same has not yet been filed as yet, as such in view of the nature of dispute the submission of learned counsel for the petitioner is that the District Magistrate, East Champaran, Motihari may be directed to dispose of the representation of the petitioner in a fixed time frame in accordance with law.

Having heard learned counsel for the parties and taking into consideration the fact that representation filed by the petitioner is pending before the District Magistrate, East Champaran, Motihari (Annexure - 3 to the writ petition), as

With the aforesaid observation and direction, the present writ application is disposed of.
