This is a petition for grant of anticipatory bail for offence under Sections 307 of the Indian Penal Code and 27 of the Arms Act.
According to first information report, the petitioner fired causing injury to his younger brother. Informant of this case is eye witness and father of this petitioner. The informant, further, alleged that firing was resorted at the informant also, however, no injury was caused to him.
The learned counsel for the informant opposed the prayer for bail.
Considering the nature of allegation against the petitioner, I am not inclined to grant anticipatory bail to the petitioner in connection with Falkaha (Pothia) P.S. Case No. 23 of 2017 pending in the Court of the Additional Chief Judicial Magistrate, V, Katihar.
The prayer for anticipatory bail is refused.
