JUSTICE VINOD KUMAR SINHA ORAL ORDER 01-02-2018 Petitioner apprehends his arrest in connection with Barhara P.S.Case No. 176 of 2017 registered for the offences under Sections 406 and 420 of the Indian Penal Code. Allegation against the petitioner is of defalcation of Rs. 5,98,455/-.

Submission of learned counsel for the petitioner is that the whole amount has already been deposited and in support of his contention he has filed Annexure-2 series.

In the facts and circumstances, this application is disposed of with a direction to the petitioner to surrender within a period of six weeks and learned court below shall examine

Patna High Court Cr.Misc. No.3705 of 2018 (2) dt.01-02-2018 2/2 Annexure-2 series and if it is found true, petitioner shall be released on bail to its own satisfaction.
