The petitioners have been in custody since 03.07.2018 in connection with Manjhagarh P.S. Case No. 187/2018 registered for the offence punishable under Sections 399/400/402 of the Indian Penal Code and Section 25(1-b) a/26/35 of the Arms Act.

Learned counsel for the petitioners submits that the present petitioners have been taken into custody on the basis of pure suspicion, in fact, there has been no recovery from them. It is submitted that while these petitioners were waiting for vehicle at the dilapidated Reliance Petroleum outlet, they were

Patna High Court CR. MISC. No.24925 of 2019(2) dt.18-04-2019 2/2 apprehended and the aforementioned recoveries have been attributed to them. It is further submitted that the petitioners are having no criminal antecedents and have been languishing in jail since long.

Considering the aforementioned facts and circumstances, let the petitioners above named be released on bail, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gopalganj, in connection with Manjhagarh P.S. Case No. 187/2018.
