ANJANA MISHRA ORAL ORDER 21-05-2019 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is apprehending his arrest in connection with Motipur P.S. Case No.77 of 2019 for allegedly having committed the offence under Sections 30(a), 38(1)(2), 41(1)(2) of the Bihar Prohibition and Excise Act, 2018. Learned counsel for the petitioner submits that the there is no recovery from the conscious possession of the petitioner.

Considering the fact that the alleged recovery was not from the conscious possession of the petitioner and also that the petitioner has got no criminal antecedents, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of

Case No.77 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
