The petitioners apprehend their arrest in Parasbigha P.S. Case No. 55 of 2016, registered for the offences punishable under Section 307 and other Sections of the Indian Penal Code. The petitioner no. 1 Raj Kumar Singh is alleged to have assaulted Amrita Kumari, daughter of the informant, with Khanti on her head and petitioner no. 2 Sumaran Singh is alleged to have assaulted Niraj Kumar with iron rod on his head. Learned counsel for the petitioners submits that there is a land dispute between the parties. Dayanand Singh, late husband of Vina Devi the informant, and father of the petitioners are brothers and they are on litigating terms. Some scuffle took place due to flow of drainage water. Patna High Court Cr.Misc. No.45679 of 2016 (3) dt.13-12-2016 2/2 got simple injuries on account of assault made by the petitioners. Considering the facts aforesaid and the fact that the occurrence took place due to land dispute and on account of assault made by the petitioners all the injured got simple injuries, the petitioners above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, 1st Class, Jehanabad in Parasbigha P.S. Case No. 55 of 2016, Subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
