JUSTICE JITENDRA KUMAR ORAL ORDER 24-11-2022 Present petition under Section 482 of the Cr PC has been filed by the petitioner for quashing the order dated 28.11.2017 passed by the learned SDJM, Nalanda at Biharsharif whereby his bail bond filed in pursuance of the provisional bail has been cancelled. The provisional bail was granted by a co-ordinate Bench of this Court vide Order dated passed in of Cr. Misc. No. 39729 of 2016. As per the aforesaid Order, the provisional bail was to be confirmed by the Court below only in the following three eventualities :- (i) On substantial restoration of the matrimonial harmony;
Patna High Court CR. MISC. No.19591 of 2018(4) dt.24-11-2022 2/2 (ii) or if the informant gets reluctant to reconcile the issue; and (iii) or if the informant fails to appear before the learned court.
However, after perusal of the impugned order, it transpires that the petitioner could not fulfill any of the aforesaid conditions. Hence, the Court below refused to confirm the provisional bail and cancelled the bail bond. As such, there is no illegality in the impugned order passed by the Court below.
Therefore, the present petition is accordingly dismissed for want of any merit in the petition. (Jitendra Kumar, J) ramesh/- U T
