Prayer is made by learned counsel for the petitioner for adjournment which the Court finds unacceptable for the reason that on 14.09.2017 on similar prayer the matter was adjourned at the instance of learned counsel for the petitioner for filing supplementary affidavit bringing on record documents in support of the relief claimed in the writ petition and the matter was directed to be listed today. The Court need not over emphasize that Special Benches have been constituted by the Court and this matter is also one of those matters before the Special Bench. On 14.09.2017 an indulgence and sufficient time was granted on the prayer made by learned counsel for the petitioner for
Patna High Court CWJC No.18383 of 2015 dt.03-10-2017 2/2 filing supplementary affidavit, but the same has neither been done nor learned counsel for the petitioner is prepared to assist the Court.

For the reasons aforesaid and non rebuttal of the averments made in the counter affidavit filed on behalf of respondents no. 3, 4 and 5, copy of which was served on learned counsel for the petitioner on 25.02.2016, the Court has no hesitation to hold that the writ petition is devoid of merit and accordingly the same is dismissed.
