The petitioners are apprehending their arrest in a case instituted under Sections 366, 302 and 201/34 of the Indian Penal Code.

Earlier the anticipatory bail application of the petitioners was rejected vide Annexure-1 to the present application. It is second attempt made on behalf of the petitioners for grant of anticipatory bail.

The prosecution case, in brief, is that on 03.07.2012, his daughter had gone to perform worship but she could not return then he received information from his Samadhi that his daughter Parbati was being kidnapped by Rajesh Rai and

On 17.07.2012, his daughter-inlaw Rani informed him that Rajesh Rai, Ankit Rai, Dinesh Rai and Sundari Devi committed murder of his daughter by setting her on fire and had taken away body for concealment. It has been submitted on behalf of the petitioners that a compromise has been entered between the parties. It has further been submitted that the other co-accused namely Rajesh Rai has already been acquitted by the learned court below. Considering the aforesaid facts and circumstances, I find no reason for interfering with the earlier order of rejection passed in anticipatory bail application of the petitioners. The same is rejected in Sarairanjan (Ghatho) P.S. Case No. 153 of 2012, pending in the court of learned Chief Judicial Magistrate, Samastipur. Any how, if the petitioners surrender in the Court below within a period of four weeks, the Court below shall consider the submissions made on behalf of the petitioners. (Sudhir Singh, J.) Amit/- U T
