ANJANA MISHRA ORAL ORDER 02-08-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State as well as learned counsel for the opposite party.

In pursuance of the last order, the petitioner is also present in Court today to submit that the opposite party No. 2 has not come to take her back ever since undertaking given by him to this Court on 01.04.2015. It appears that the said undertaking was just a hoax intended to defeat the cause of justice and obtain an order in his favour for grant of pre-arrest bail.

Considering the fact that more than two years have passed and no steps have yet been taken by the opposite party No. 2 to

Patna High Court Cr.Misc. No.12685 of 2017 (5) dt.02-08-2017 P2/2 take the petitioner back to her matrimonial home, the order dated 01.04.2015 is, accordingly, recalled.

It shall be open to the Court below to proceed in accordance with law to cancel the bail bonds furnished by the opposite party No. 2.
