The petitioner apprehends his arrest in Hajipur Sadar P.S. Case No.514 of 2017 registered under Sections 341, 447, 323, 354, 379, 504, 506, 34 of the Indian Penal Code. The informant alleged that Rajendra Ram came near the tubewell situated in front of her house to take water. The informant asked him not to wash slipper in front of her door. On such, some altercation took place. It is further alleged that the petitioner and others came and assaulted the informant and put her down on the ground.
The learned counsel for the petitioner submits that the petitioner and the husband of the informant are cousin. Petitioner
Patna High Court Cr.Misc. No.5165 of 2018 (2) dt.02-02-2018 2/2 is next door neighbour and co-sharer of the husband of the informant. The allegation of outraging modesty of the informant does not arise. Only some altercation took place between the members of the two families.
Considering the facts aforesaid and the fact that petitioner happens to be cousin of the husband of the informant and FIR was lodged after one week of the date of occurrence, the petitioner, above named, in the event of his arrest or surrender before the learned Court below within a period of four weeks from the date of receipt / production of a copy of this order is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Vaishali at Hajipur in connection with Hajipur Sadar P.S. Case No.514 of 2017, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
