The petitioners apprehend their arrest in Sakra P.S. Case No.426 of 2018 registered under Sections 406, 420, 467, 468, 323, 504, 120(B), 34 of the Indian Penal Code. The informant filed complaint petition on the basis of which the present F.I.R. was lodged. The informant alleged that the petitioners negotiated with her husband to purchase 6 dhurs of land on payment of consideration amount of Rs.5 lacs but since her husband is an illiterate person, the petitioners inserted 17 dhurs of land in the sale deed and also paid only Rs.2,25,000/- as consideration amount.

No.25854 of 2019(2) dt.22-04-2019 2/2 The learned counsel for the petitioners submits that the husband of the informant executed a sale deed in presence of the Sub-Registrar. The Sub-Registrar inquired from the vendor and only thereafter, he put his thumb impression. Later on, the informant(wife of the vendor) wanted to extract more money and that is why the present case has been lodged. Taking into consideration the facts aforesaid and nature of allegation made against the petitioners, let the petitioners, above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Sub Judge XIII-cum-A.C.J.M. IV, Muzaffarpur in connection with Sakra P.S. Case No.426 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
