The petitioner apprehends his arrest in connection with Alamganj P.S. Case No. 276 of 2016 (G.R. No. 3298 of 2016), registered for the offences punishable under Sections 30(A) of Bihar Prohibition and Excise Act, 2016.
At the very outset, it is submitted that in this case the petitioner and his brother Shankar Sao have been made accused that they were identified by the police when they succeeded in fleeing away at the time of unloading the pick up van and from pick up van 108 bottles, each containing 750 ml. foreign made country made liquor kept in 9 cartoons each containing 12 bottles were recovered.
Patna High Court Cr.Misc. No.1082 of 2017 (2) dt.17-01-2017 2/2 Submission is of false implication and that similarly situated the brother of the petitioner Shankar Sao has been allowed pre-arrest bail vide Cri. Misc. No. 55693 of 2016 by order dated 13.01.2017 and, as such, petitioner deserves sympathetic consideration.
The learned A.P.P. fairly submits that the brother of the petitioner has been allowed pre-arrest bail. In the facts and circumstances as stated above, on that ground the petitioner in the event of his arrest or surrender within four weeks from the date of receipt/production of a copy of this order shall be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Patna City, in connection with Alamganj P.S. Case No. 276 of 2016 (G.R. No. 3298 of 2016), subject to the conditions as laid down in section 438(2) of the Cr.P.C.
