JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 30-08-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State. No one appeared on behalf of O.P. No.2. The petitioner apprehends his arrest in connection with Chandi P.S. Case no. 327 of 2016, registered under Sections 420, 406, 323, 504 and 120-B/34 of the Indian Penal Code. Learned counsel for the petitioner submits that on the joint prayer of the parties, the matter was referred to the Mediation Centre, Patna High Court, Patna. Further submission is that petitioner and O.P. No.2 settled their dispute and entered into an agreement on 23.08.2017, accordingly, the petitioner will execute the sale deed of 10 decimal of land, which is in dispute, on payment of Rs. 50,000/- by O.P. No.2 and both the parties will withdraw the cases after execution of the sale deed.

The Mediator's report dated 25.08.2017 shows that

Patna High Court Cr.Misc. No.6399 of 2017 (10) dt.30-08-2017 2/2 dispute between the petitioner and O.P. No.2 has amicably been settled in terms of the agreement dated 23.08.2017, which is the part of the report.

Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Addl. Chief Judicial Magistrate, Nalanda in connection with Chandi P.S. Case No.327 of 2016, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
