The petitioner has preferred this application for grant of regular bail in a case registered under section 302 and other sections of the Indian Penal Code.

As per the prosecution case, it is stated that the eleven named accused persons including the petitioner herein came variously armed. On the orders of the accused Thag Mian it is stated that all the accused persons assaulted the father of the informant leading to his death.

It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case. Even as per the FIR the allegations are general and omnibus in nature. The cause of false implication of the petitioner is pendency of Title Suit no. 44 of 2017 pending in the Court of learned

Patna High Court CR. MISC. No.35334 of 2021(6) dt.10-03-2022 2/2 Munsif, Bettiah, West Champaran. The petitioner is in custody since 5.1.2021 and has no criminal antecedent. Heard learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the general and omnibus allegations in the FIR together with the petitioner having remained in custody for more than 1 year, the Court directs the petitioner to be enlarged on bail in connection with Nautan (Jagdishpur) P.S. Case no. 241 of 2020 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M, Bettiah, West Champaran.
