The petitioner apprehends his arrest in Parsa Bazar P.S. Case No. 38/2013, registered for the offences punishable under Section 396 of the Indian Penal Code and 27 of the Arms Act.

Learned counsel for the petitioner submits that the petitioner is not named in the FIR. Name of the petitioner figured in the case in the confessional statement of Bholi Ram @ Karu who has already been granted regular bail. Save and except confession, there is no material against the petitioner to show the involvement of the petitioner but it appears from the record that the case under Section 396 of the Indian Penal Code is found true against the petitioner. The investigating Officer requires custodial

Patna High Court Cr.Misc. No.46720 of 2016 (2) dt.02-12-2016 2/2 interrogation of the petitioner and the petitioner may be put on Test Identification Parade, as the informant and others claimed to identify the petitioner.

Considering the facts aforesaid, I am not inclined to enlarge the petitioner above named on anticipatory bail. Accordingly, the same is rejected.
