The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 147, 149, 341, 323, 354B, 307, 379 of the Indian Penal Code.
The prosecution case is that the informant and his family members were at Burhnath Temple, Bhagalpur for performing the marriage of younger brother of the informant. In the meantime 10-15 persons in a drunken condition came and started pulling the girl, who were sitting in the vehicle. On protest being made, the accused persons assaulted the informant's younger brother. The accused persons caught hold the younger brother of the
Patna High Court Cr.Misc. No.54817 of 2015 (2) dt.04-12-2015 informant Chhotu and assaulted with belt and bamboo stick. When the wife of the informant came to rescue, then she was also being assaulted by the accused persons. The accused persons also snatched chain from the wife of the informant.
It is submitted by the learned counsel for the petitioner that the accusation is omnibus and general. Statement has been made in para-3 of the petition that petitioner has no criminal antecedent.
Considering the general nature of accusation and co-accused Vikash Yadav @ Vikash Kumar Yadav has been granted anticipatory bail vide Cr. Misc. No. 49079 of 2014, let the above named petitioner be released on bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhagalpur in connection with Kotwali (Adampur) P.S. Case No. 133 of 2014, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Dinesh Kumar Singh, J) P.K./- U T
