JUSTICE ARVIND SRIVASTAVA ORAL ORDER 01-11-2017 Learned counsel for the petitioners submits that during the pendency of this application, petitioner no. 2 has been arrested.

In such view of the matter, the application of petitioner no. 2 Sagar Kumar Singh @ Manjeet Kumar Singh, @ Sanjeet Kumar Singh, is dismissed as withdrawn. Heard learned counsel for the petitioner no.1 Abhishek Kumar Singh and the learned A.P.P. for the State. The petitioner no. 1 Abhishek Kumar Singh, apprehend arrest in connection with Belhar (Khesar) P.S. Case No. 30 of 2015 registered under Section 395 of the Indian Penal Code. Learned counsel appearing on behalf of the petitioner

Patna High Court Cr.Misc. No.36354 of 2017 (4) dt.01-11-2017 2/2 submits that only on the confessional statement of co-accused, petitioner has been made accused in this case. Further submission is that nothing has been recovered from the possession of the petitioner.

Having considered the facts and circumstances of the case, let the above named petitioner no. 1 Abhishek Kumar Singh, be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the S.D.J.M., Banka in connection with Belhar (Khesar) P.S. Case No. 30 of 2015, subject to the condition as laid down under Section 438(2) of the Cr. P.C.
