JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 06-04-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner seeks pre-arrest bail in connection with Taraiya P. S. Case No. 287 of 2017 registered under Sections 341, 323, 324, 307 and 504/34 of the Indian Penal Code. It is submitted by the learned counsel for the petitioner that there is case and counter-case. Though there is allegation that the petitioner assaulted the informant by a sharp cutting weapon, the injuries sustained on his person were opined by the doctor to have been caused by hard and blunt substance and were found simple in nature. It is further submitted that from the side of the petitioner also, three persons sustained injuries though

The petitioner has got no criminal antecedent and having got roots in the society, he is not likely to abscond or tamper with the evidence. Learned Additional Public Prosecutor for the State opposed the prayer for grant of pre-arrest bail to the petitioner. Considering the nature of allegation and the submission made above, in the event of arrest or surrender before the court below within six weeks from today, the petitioner named above is directed to be released on bail on furnishing bail bond of Rs.10,000/- ( Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-IX, Saran at Chapra in Taraiya P. S. Case No. 287 of 2017, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
