JUSTICE ADITYA KUMAR TRIVEDI ORAL ORDER 27-03-2017 After some argument, learned counsel for the appellants seeks permission to withdraw the instant memo of appeal under the garb of observation having been made under Para-28 in Bisheshwar Mishra and another vs. State of Bihar reported in 2016(4) P.L.J.R. 1058 (D.B.) and the same is allowed. Accordingly, instant memo of appeal is dismissed as withdrawn.

However, the learned lower Court will consider the prayer for regular bail in case so made, without being prejudiced by the instant order.
