The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 353, 323, 332, 504, 506 and other allied sections of the Indian Penal Code. As per the prosecution case, the brother of informant went missing and later on, his dead body was found. It is submitted that petitioner is not named in the FIR. Name of the petitioner transpired during course of investigation in the statement of witness namely, Lalo Yadav who stated that on the alleged date and time of occurrence he saw his covillager namely, Ramchandra Yadav, Binod Choudhary, Doman Choudhary (petitioner), Jalo Sahni, Biro Sahni, Kanti

Patna High Court CR. MISC. No.26864 of 2023(2) dt.07-07-2023 2/2 Sahni and Ramprit Sahni were talking by the road side. It is further stated that co-accused Binod Yadav and this petitioner also threatened the deceased. Save and except this fact, there is no material against this petitioner which suggest his complicity in the alleged occurrence. Petitioners claim clean antecedents. Considering the facts aforesaid, the petitioner abovenamed, in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Manjahul, Begusarai in connection with Khodawandpur P.S.
