The petitioner seeks pre-arrest bail in connection with Khaira P.S. Case No. 35 of 2015 registered under Section 364-A read with 34 of the Indian Penal Code.

It is contended that the petitioner is neither named in the FIR nor any incriminating material has been collected against him in course of investigation. His name has transpired merely on confessional statement of arrested accused British Yadav with whom the petitioner was on inimical terms. On the other hand, learned counsel for the State has vehemently opposed the application for grant of anticipatory bail

Patna High Court Cr.Misc. No.53914 of 2015 (2) dt.08-12-2015 2 / 2 to the petitioner. He has contended that investigation of the case is going on and custodial interrogation of the petitioner may be warranted in the case.

Regard being had to the nature of allegation and the materials collected against the petitioner in course of investigation, I am not inclined to grant him anticipatory bail. Accordingly, the application for anticipatory bail is rejected. (Ashwani Kumar Singh, J.) Sanjeet/- U T
