The petitioner is apprehending his arrest in connection with Sour-Bazar P.S.Case No. 68 of 2017 registered for the offence under Sections 406 and 420/34 of the Indian Penal Code. Allegation against the petitioner and other accused person is that they have taken away 50% of the loan amount paid to the informant.
Submission of learned counsel for the petitioner is that there is delay in lodging FIR and further submission is that except he was present in Bank there is nothing against him as neither he is broker nor an employ of the Bank.

Having heard both sides and in view of the facts and
Patna High Court Cr.Misc. No.36664 of 2017 (2) dt.11-08-2017 2/2 circumstances, let petitioner, above named, surrender within a period of four weeks before the court below and on his so surrendering he shall be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Saharsa, in connection with Sour-Bazar P.S.Case No. 68 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further condition is that one of the bailors should be a local person having sufficient properties within the jurisdiction of court concerned and he will co-operate in investigation of the case and make himself available before the investigating officer as and when required, failing which his bail bond shall be cancelled.
