JUSTICE PRABHAT KUMAR JHA ORAL ORDER 20-09-2016 Heard the learned counsel for the petitioner, the learned counsel for the informant and the learned Additional Public Prosecutor.

The petitioner apprehends her arrest in Turkauliya P.S. case No.337 of 2015 under Section 406, 420/120B of the Indian Penal Code.

The informant alleged that marriage of his sister was settled with Sanyashi Kumar, son of Ishwar Chandra Mahto. The marriage was to he held on 29.04.2015. The informant and his father gave ornaments, money as dowry but before marriage father of bridegroom, mother of bridegroom and other relatives

Patna High Court Cr.Misc. No.39927 of 2016 (2) dt.20-09-2016 2/2 demanded dowry.

It is submitted that petitioner is mother of bridegroom. No specific allegation of demand of dowry is made against the petitioner. The petitioner never demanded any dowry. Considering the facts aforesaid and the nature of allegations made against the petitioner and the fact that petitioner is mother of bridegroom, the above named petitioner, in the event of her arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, East Champaran at Motihari in Turkauliya P.S. Case No. 337 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Jha, J) BKS/- U T
