The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 302, 120B of the Indian Penal Code and 27 of the Arms Act. It is alleged that four persons including the petitioner caught hold of the brother of the informant when he was shot dead by co-accused Tinku.
It is submitted by learned counsel for the petitioner that it appears unreasonable that petitioner and others caught hold of the victim when co-accused fired. Since the petitioner earlier lodged a case against the informant side, hence,
Patna High Court Cr.Misc. No.54021 of 2015 (2) dt.27-11-2015 2/2 as a retaliatory measure the present case has been lodged. A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. The aforesaid facts constitute ground for consideration of prayer for regular bail, if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with Kanti P.S. Case No. 381 of 2015 pending in the court of learned Chief Judicial Magistrate (West), Muzaffapur.
With the aforesaid observation, this application is disposed of.
