Let the defect(s), if any, be removed within a period of four weeks from today.

The petitioner seeks bail in connection with Khajanchi Hat P.S. Case No. 130 of 2023 arising out of Special (NDPS) Case No. 28 of 2023 registered for the offence under Section 275, 276 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act, 21C of NDPS Act and 27(I)(II) 27C of Drug and Cosmetic Act.

Learned counsel for the petitioner submits that the petitioner is in custody since 31.01.2023 and there is recovery of 19 litres of codein cough syrup from his possession and he has no criminal antecedent.

Learned APP has vehemently opposed the prayer of bail.

Patna High Court CR. MISC. No.28186 of 2023(2) dt.15-05-2023 2/2 Considering the period of custody and recovery of liquor from his possession, this application for regular bail is allowed.

Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, NDPS Act, Purnea in connection with Khajanchi Hat P.S. Case No. 130 of 2023 arising out of Special (NDPS) Case No. 28 of 2023.
