The petitioner apprehends his arrest in connection with Gaighat P.S. Case No.141 of 2016 registered under Section 409 of the Indian Penal Code.
The allegation of the informant Bipin Kumar, Panchayat Secretary, Gram Panchayat-Raj Laxman Nagar, is that while on 23.11.2011, the petitioner made over the charge of the Panchayat Secretary of Raj Laxman Nagar Gram Panchayat but he did not handover the charge in respect of the appointment of Panchayat Teachers of the year 2003-2011. Regarding the same, the information was given by the informant on 18.02.2016 vide Letter No.10 of the District Programme Officer, Muzaffarpur.
Patna High Court Cr.Misc. No.53582 of 2016 (3) dt.20-12-2016 2/3 Learned counsel appearing on behalf of the petitioners submits that in the light of the order dated 27.06.2009 of the District Programme Officer Muzaffarpur, contained in Memo No.868 and the order dated 04.07.2009 contained in Memo No.588 of the Block Development Officer, Madwan, the petitioner joined as Panchayat Secretary on 07.07.2009 in Gram PanchayatRaj Laxman Nagar but the then Panchayat Secretary did not hand over the charge to him regarding which the information was given to the Block Development Officer, Gaighat, on 26.12.2009 upon which he was directed by the Block Development Officer, Gaighat vide Memo No.31 dated 08.01.
2016 to get upto date all the accounts of the Bank after consulting with the Mukhiya and, accordingly, prepare new account, Yojana Panji and to get the cheque book, After knowing about lodging of the present case, the petitioner has sent a letter dated 23.10.2016 to the District Magistrate, Muzaffarpur, about lodging of the present case without asking explanation by the B.D.O. from him Having considered the facts and the circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender by him within six weeks from today, be enlarged on bail on his furnishing bail bond of Rs.
